Anti-doping- Cyclist (M) tested positive for prohibited substance Clenbuterol in sample taken from him during Tour of Northland – provisionally suspended without opposition – defended anti-doping violation raising two issues – first (M) alleged he was wrongly deprived of his right to have a representative during testing process – second (M) maintained he was not given choice of sample collection beaker, but handed an unsealed beaker by Doping Control Officer – conflicting evidence from witnesses during hearing about what took place during sample collection process – Tribunal satisfied appropriate process followed – anti-doping rule violation was proven – issue of sanction* adjourned pending CAS decision.
