Appeal against decision of NSO – non-nomination – M appealed against decision of Olympic Weightlifting New Zealand to not nominate her for NZ weightlifting team to compete at 2016 Rio Olympic Games – contested sole female weightlifting slot allocated to New Zealand by International Weightlifting Federation – whether Nomination Criteria properly followed or implemented – M contended selectors failed to give sufficient weight to recent results and Sinclair scores and extenuating circumstances due to illness which affected performance at a Key Event – whether non-nomination decision affected by apparent bias – selector’s association with nominated athlete’s club and training partner and comments made to M – Tribunal concluded selectors had reasonably applied nomination criteria – appropriate emphasis on performances at Key Events, track record and IWF World Rankings – took into account extenuating circumstances – test for apparent bias not met – appeal dismissed.
